The purpose of this Terms of Service
Statement is to inform you about the terms you agree to when you are using the
Northland Laboratories Milk Patron Result System ("our Site"), your
responsibilities, how will the information may be used, whether we disclose it
to anyone, and the choices you have regarding our use of, and your ability to
correct, that information.

Description of Service
Northland Laboratories currently provides
users employed by companies who do business with Northland Laboratories (Your
Company), or Milk Producers or Patrons who Your Company chooses to test their
milk samples and Your Company authorizes and assigns access to their analytical
and test data via internet access (the Milk Patron Result System). If you are a
company, you understand and agree that access to Your Company’s data is the
property of Northland Laboratories and Your Company, and you may only access
and use this information for authorized business uses of the Your Company. If
you are a Milk Producer or Patron, you understand and agree that you may only
access your information on your samples only and the use of this information is
only to be used for authorized uses for your farm.
Access to the Site
You acknowledge that Northland Laboratories does not pre-screen users before
activation. If an account is requested through the Milk Patron Result System on
an active Super User Account, we assume that granting access to the Milk Patron
Result System on your account is acceptable to you and Your Company.
You acknowledge and represent to Northland
Laboratories that you are a current employee or an authorized agent of Your
Company, or an authorized Milk Producer or Patron and have the authorization
from Your Company to access, view, use, request and print analytical data of
Your Company’s or Farm’s products and testing for Your Company’s or Farm’s
business use only.
You acknowledge that accessing Your
Company’s or Farm’s data while not being or no longer being authorized to
accessing Your Company’s or Farm’s data may subject you personally to violating
any duties or responsibilities of confidentiality you have with Your Company or
your Farm.
Confidentiality
Use of this system obligates you to observe
Your Company’s or Farm’s Confidentiality policy at all times. You acknowledge
that the data in the eAccess System pertaining to Your Company is of
confidential nature and must be held in confidence at all times.
Termination
You agree that Northland Laboratories, at
its sole discretion, may terminate your account, password, or any part thereof,
or use of the Milk Patron Result System, for any reason, including, without
limitation, for lack of use or if Northland Laboratories believes that you have
violated or acted inconsistently with the letter or spirit of the Terms of
Service. Northland Laboratories may also in its sole discretion and at any time
discontinue providing the Milk Patron Result System, or any part thereof, with
or without notice.
LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT
NORTHLAND SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR
LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF
NORTHLAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
(i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT
OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR
SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED
INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF
YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON
THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE
Sharing Your Information
We do not sell, trade, or rent to others the
Personally Identifiable Information we collect online. Where Northland
Laboratories may engage in third parties to perform services on our behalf, we
will require them to observe the intent of this Online Privacy Statement. On
some pages we offer you the opportunity to receive information from companies
with products or services that may be of interest to you. If you choose to
receive such information, Northland Laboratories may assist these companies in
their marketing activities by forwarding their messages to you, but we will not
provide these companies with any of your Personally Identifiable Information.

user account is registered and active, you may access and change your
